Please read this agreement carefully. By accessing the Internet through an OVIS account, utilizing web hosting or other services you (Customer) agree to be bound by the terms of this agreement and OVIS's Acceptable Use Policy.

If you do not agree to all of the terms and conditions set forth below you may not access or use any OVIS service. You may return the OVIS software or discontinue any service for a full refund within 14 days of your account start date.

Registration Requirements

• You must be at least 18 years old to register for any Service.
• Minors who access this Service are assumed to have parental or guardian consent before accessing this Service.
• You agree to provide us with accurate and complete billing information. This information must include your name, address, and telephone number. Any changes to this information must be reported to OVIS within 30 days.
• You agree that you will be responsible for all charges posted to your account until you cancel the account by one of the specified methods as described below.

Billing

• Invoices are generated automatically on the 1st of each month and sent to each customers @ovis.net e-mail address. The only exception to this is for customers using WebTV.  WebTV customers must notify us of their e-mail address on WebTV's service.
• OVIS reserves the right to change prices and institute new fees. OVIS will announce price increases or decreases on our website, via email or conventional mail at least 30 days before such changes are to take effect.
• Your account will renew automatically for the entire term of your billing cycle (i.e. monthly, bi-annually, annually).
• To cancel your subscription you must inform us in writing by e-mailing billing@ovis.net or address US Mail to: Ohio Valley Internet Service, Attention: Billing Dept., 1816 7th Street, Moundsville, WV 26041.  Please remember to include your username and real name in your correspondence. If we do not receive a written request, you will be liable for the continued billing of your account and will be responsible for paying any outstanding charges.
• Cancelled accounts are deactivated at the end of their billing cycle. OVIS does not issue refunds on the unused portion of a monthly account. 
• Accounts are considered delinquent if payment is not received by the due date marked on the invoice. Access to your account may be suspended or canceled without notice at the sole discretion of OVIS.  
• OVIS may impose a fee of $10.00 to reactivate an account which has been suspended for non-payment
• You agree to pay all attorney and collection fees arising from efforts to collect any unpaid balance on your account.
• A service charge of $20.00 will be assessed to a member's account for each check that is returned to OVIS for insufficient funds.
• If you believe that we have billed you in error, please contact us within 15 days of the invoice or transaction date of the charge.

Use of the Service

• You must ensure that usage of your account complies with all of the terms and conditions of this Agreement and OVIS Acceptable Use Policy.
• You are responsible for maintaining the confidentiality of any and all passwords used to access the Service.
• You are responsible for all activities and charges assessed as a result of use of your passwords and account in connection with the Service.
• You must notify us within 24 hours of discovering any unauthorized use of your account.
• You are responsible for all local and long distance telephone charges for connection to the Service by you..
• You agree not to use the Service or permit others to use the Service through your account in any way which violates any international, federal, state, or local law or regulation; subjects OVIS to liability; or is not in compliance with OVIS's Acceptable Use Policy.

Limitation of Liability

• In no event shall Ohio Valley Internet Service. be liable to Customer for any damages or loss resulting from any failure, delay or service interruption in providing access to the internet under the terms of this agreement. In no event shall Ohio Valley Internet Service. be liable to Customer for any direct, indirect, special or consequential damages or lost profits arising out of or related to this agreement. Any claim arising out of this agreement shall be brought within 3 months or said claim shall be deemed to be waived. Customer agrees that in no event shall Ohio Valley Internet Service's liability exceed the total amount Customer paid via their subscription plan.
